1. General Provisions

These Terms of Service ("Terms") govern your access to and use of the services offered through the swipela.app website and the Swipela mobile application (collectively, the "Service").

By accessing or using the Service, you represent that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Swipela ("Swipela", "we", "us", or "our") reserves the right to modify these Terms at any time. Changes take effect upon publication on the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

2. Description of the Service

Swipela is a fashion discovery and wardrobe management platform that offers the following services:

  • Discovering products from different brands through a swipe-based interface
  • Personalised style recommendations and a style quiz
  • Cross-brand price comparison
  • Digital wardrobe building and outfit creation
  • Community features (sharing, interactions, editor picks)
  • Discount and deal notifications

Swipela is not a marketplace. Swipela does not sell products; it redirects users to the websites and applications of third-party brands and retailers. Purchase transactions are carried out directly on the platform of the relevant brand or retailer.

3. Account Registration and Security

3.1. Account Registration

You must create an account to access certain features of the Service. When creating an account, you agree to provide accurate, current, and complete information. Individuals under the age of 16 may not create an account.

3.2. Account Security

You are responsible for the security of your account. You must keep your password confidential and must not share it with third parties. In the event of any unauthorised access to or use of your account, you must immediately notify us at support@swipela.app. You are responsible for all activity that occurs under your account.

3.3. Account Suspension and Termination

Swipela reserves the right to suspend or terminate your account if it determines that you have violated these Terms, or for any other reason at its sole discretion. You may delete your account at any time through the application settings or by contacting support@swipela.app.

4. Rules of Use

You agree to comply with the following rules when using the Service:

4.1. Acceptable Use

  • Use the Service only for personal and non-commercial purposes
  • Comply with all applicable laws and regulations
  • Respect the rights of other users
  • Provide accurate and up-to-date information

4.2. Prohibited Conduct

The following conduct is strictly prohibited:

  • Using the Service for any illegal, fraudulent, or harmful purpose
  • Impersonating any person or providing misleading information
  • Accessing the Service or collecting data through automated tools, bots, crawlers, scrapers, or similar software
  • Taking any action that damages or interferes with the infrastructure, security, or operation of the Service
  • Distributing viruses, malware, or malicious code
  • Sending spam, unsolicited commercial communications, or advertisements through the Service
  • Sharing content that harasses, insults, threatens, or discriminates against other users
  • Publishing obscene, pornographic, violent, or hate speech content
  • Sharing content that infringes the intellectual property rights of third parties
  • Reverse engineering, decompiling, or modifying any part of the Service
  • Using, reselling, or distributing the Service or its content for commercial purposes without the prior written consent of Swipela

5. User Content

5.1. Content Responsibility

You are solely responsible for all content that you share, upload, or create through the Service ("User Content"). You represent and warrant that your User Content is accurate, does not infringe the rights of third parties, and complies with applicable law.

5.2. Licence

By sharing User Content through the Service, you grant Swipela a worldwide, non-exclusive, royalty-free, sublicensable licence to use, copy, modify, distribute, and display such content for the purpose of providing, improving, and promoting the Service. This licence terminates within a reasonable period following the deletion of your account (subject to legal retention obligations).

5.3. Content Removal

Swipela reserves the right to remove or restrict access to any User Content that violates or is reasonably believed to violate these Terms or applicable law, without prior notice.

6. Intellectual Property Rights

6.1. Swipela's Rights

The Service and all of its components (including but not limited to software, design, graphics, logos, text, audio, video, and other materials) are the intellectual property of Swipela or its licensors and are protected by national and international copyright, trademark, patent, and other intellectual property laws.

6.2. Limited Licence

Subject to your compliance with these Terms, Swipela grants you a limited, non-exclusive, non-transferable, and revocable licence to use the Service for personal, non-commercial purposes. This licence does not include any right to reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of the Service.

6.3. Third-Party Content

Product images, brand logos, product descriptions, and pricing information displayed on the Service belong to the respective brands and retailers. The display of such content on the Service does not constitute a transfer of the associated intellectual property rights.

7. Third-Party Services and Links

The Service contains links to third-party websites, applications, and services. These links are provided for convenience only.

  • Purchases made on third-party platforms are subject to the terms and conditions of those platforms.
  • Swipela makes no warranty regarding the quality, price, availability, or delivery of third-party products.
  • Swipela is not responsible for disputes you may have with third-party platforms.
  • Price information is kept as up to date as possible; however, real-time accuracy is not guaranteed.

8. Limitation of Liability

8.1. Service Delivery

The Service is provided on an "as is" and "as available" basis. Swipela makes no express or implied warranty that the Service will be uninterrupted, error-free, or secure. Swipela makes no warranty as to the fitness of the Service for any particular purpose, merchantability, or non-infringement.

8.2. Limitation of Liability

To the maximum extent permitted by applicable law, Swipela and its directors, employees, partners, and affiliates shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from:

  • The use of or inability to use the Service
  • Transactions carried out on third-party platforms accessed through the Service
  • Inaccuracies or outdated information in pricing data
  • Unauthorised access to the Service or data breaches
  • The quality of third-party products or services
  • Technical failures, errors, or interruptions in the Service

In any event, Swipela's total aggregate liability shall not exceed the total amount you have paid for the Service in the 12 months preceding the relevant event, or TRY 100 if no payment has been made.

8.3. Force Majeure

Swipela shall not be held liable for any Service interruptions or degradations resulting from natural disasters, war, terrorism, pandemics, strikes, government actions, infrastructure failures, or other events beyond its reasonable control.

9. Indemnification

You agree to indemnify, defend, and hold harmless Swipela, its directors, employees, and business partners from and against any and all claims, actions, damages, liabilities, costs, and expenses (including legal fees) arising from your violation of these Terms, misuse of the Service, or infringement of any third-party rights.

10. Privacy

The collection, processing, and protection of your personal data is governed by our Privacy Policy. By using the Service, you represent that you have read and accepted our Privacy Policy.

11. Service Modifications

Swipela reserves the right to modify, update, suspend, or discontinue the Service or any feature thereof at any time without prior notice. Swipela shall not be liable to you or any third party for any modification or discontinuation of the Service.

12. Termination

These Terms remain in effect until your account is deleted or terminated by Swipela. Upon termination:

  • Your right to access the Service terminates immediately.
  • The content licence granted under Section 5.2 terminates within a reasonable period following account deletion.
  • Provisions that by their nature should survive termination (including Sections 6, 8, 9, 14, and 15) shall continue in full force and effect.
  • Your personal data will be processed in accordance with our Privacy Policy.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be deemed modified to the minimum extent necessary to comply with applicable law, and the remaining provisions shall continue in full force and effect.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. The courts and enforcement offices of Istanbul shall have exclusive jurisdiction over any disputes arising from or in connection with these Terms or the use of the Service.

15. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between the parties regarding the use of the Service and supersede all prior agreements on this subject.
  • Waiver: The failure of Swipela to enforce any provision of these Terms at any time shall not constitute a waiver of that provision or of the right to enforce it in the future.
  • Assignment: You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Swipela. Swipela may freely assign these Terms.
